Buying is done on the website www.opgnovosel.hr by completing the form provided for that purpose. When filling in the form, the buyer is obliged to enter all the information required of him. The purchase can be made with the confirmation of the buyer that he has previously read and understood the General Terms and Conditions and that he has agreed to them and that he is aware that this is an order with an obligation to pay. Shopping is possible 24 hours a day, 7 days a week. OPG Novosel is not responsible for the costs of using computer equipment and telecommunications services necessary for access to the service. The buyer will be notified by e-mail of the order confirmation (receipt of an e-mail containing the buyer's offer) and again when sending the shipment.
In the event that OPG Novosel is for any reason unable to deliver any of the ordered products, the employee of OPG Novosel will contact the customer by phone or e-mail for the purpose of agreeing on the delivery of the replacement product or possible cancellation of the ordered product.
The purchase of products and/or services in the name and on behalf of a minor or a person deprived of legal capacity (fully or partially), may only be requested by their legal representatives.
The purchase is made by ordering available products that the buyer chooses based on the photo and the basic description. The purchase is made in a few simple steps in the comfort of the customer's home, from anywhere in the world.
The order of the product is carried out electronically. By clicking on the ‘Add to cart’ icon, the selected product is added to the cart. By placing the product in the cart, the product is neither booked nor ordered nor purchased. The buyer can continue to add products by clicking on "Continue shopping" or review the shopping cart by clicking on "View cart" or complete the product selection process by clicking on "Finalise shopping". In this step, the buyer enters the code if he owns a coupon or gift voucher.
When the customer completes the product selection process by clicking on “Complete shopping” he/she will be redirected to the page where the customer enters the information needed for delivery, selects the payment method and the delivery method. In the event that OPG Novosel is for any reason unable to deliver any of the ordered products, the customer will be contacted by phone or e-mail by an employee of OPG Novosel for the purpose of agreeing on the delivery of the replacement product or possible cancellation of the ordered product.

PRICE
Prices represent retail prices, expressed in euros (EUR) and include VAT and are valid for all payment methods at the time of purchase.
In conclusion with the purchase, the price is valid on the day of the order, i.e. all ordered goods will be delivered at prices that were valid when the offer was made, i.e. at the time of the order.
OPG Novosel reserves the right to change prices at any time without prior notice and initiate price reductions and special actions.
OPG Novosel will periodically, at its discretion, put certain products on sale.
Products will be available on the same terms to all customers or will be available to customers of a specific, precisely specified group. The conditions of the action sale will be described in detail, in particular the duration of the action sale, the limit of the quantity of goods, the amount of the discount, etc.

If possible, we will make every effort to deliver at approximately the desired time. If this is not feasible, we will contact you to agree on a different delivery date on the same day.

EXPLANATORY AND DEVELOPMENT OF APPLICATION
The purchase agreement was concluded at the moment of acceptance of the buyer's offer, and the product will be shipped to the delivery service within 1-3 working days (Saturday, Sunday and non-working days excluded) upon receipt of payment of the purchase price.
*Note: the delivery time may deviate from the above in some periods of the year, for example we list the days of large orders such as Black Friday, Christmas, etc. In this case, please understand, and we will further inform customers.
The product will be delivered to the buyer in the territory of the Republic of Croatia within 2-5 working days (Saturdays, Sundays and non-working days excluded) from the delivery of the product to the delivery service, except for delivery to the Croatian islands.
RIGHT TO THE ONE CONTRACT OF THE CONTRACT
The buyer has the right not to state the reasons, unilaterally terminate the contract concluded off-premises or concluded at a distance within 14 days.
The period in question shall begin to run from the date on which the goods forming the subject of the contract are handed over to the buyer or to a third party designated by the buyer, other than the carrier.
If, by one order, the buyer has ordered several pieces of goods to be delivered separately, or if the goods are delivered in more than one piece or more shipments, the time limit begins to run from the day from when the buyer or a third party designated by the buyer, other than the carrier, is handed over the last piece or the last shipment of goods.
If the Seller does not inform the Buyer of the right to unilaterally terminate the contract, this right ends within 12 months from the expiration of the termination period (the 12-month period starts to run after the expiration of the 14-day period provided for regular termination in the event of proper notification). If the notice of the right to unilateral termination is delivered within 12 months, the right to unilateral termination shall cease at the expiry of a period of 14 days from the date of receipt of the notice by the buyer.
In order for the buyer to exercise the right to unilateral termination of the contract, he must notify the seller of his decision to unilaterally terminate the contract before the expiration of the 14-day period by an unambiguous statement sent by post to OPG Novosel, Samci 67/a, 49245 Gornja Stubica, by e-mail to info@opgnovosel.hr in which he will state his name, address, telephone number or e-mail address, and the buyer can, of his choice, use the example of the unilateral termination form provided below. A copy of the form for unilateral termination of the contract can be completed electronically by the buyer.
Acknowledgement of receipt of the notice of unilateral termination of the contract will be sent to you, without delay, by e-mail.
The Buyer is obliged to return the goods without delay, and at the latest within 14 days from the date on which he informed the Seller of his decision to terminate the contract.
The Seller undertakes to return to the Buyer the amount of the paid funds reduced by the amount of the delivered delivery within 14 days after receiving the written notice of termination of the contract after the Seller has verified and accepted the returned goods, which must be in the original state.
The seller is not obliged to make a refund paid before the goods delivered to the buyer are returned to him.
The Seller is not obliged to refund the amount of the charged delivery.
The Seller undertakes to make a refund by using the same means of payment used by the Buyer at the time of payment unless the Buyer expressly agrees to another means of payment, and on the assumption that the Buyer is not obliged to pay any additional costs for such a refund.
The goods must be returned in their original condition, must not be worn or used and must be returned with all the original labels and invoice.
The buyer is in accordance with Article 77, paragraph 5. The Buyer Protection Act is responsible for any impairment of the purchased product resulting from the handling of the purchased product, except that which was necessary to determine the nature, characteristics and functionality of the goods.

RECOMMENDATIONS AND MATERIALS
If the Buyer identifies material defects on the goods upon receipt, complaints can be registered at the e-mail address: info@opgnovosel.hr or orally at the phone number: +385 922879871, on weekdays from 8-15 h.
In case of a justified complaint, it is possible to terminate the contract with a refund of the paid amount or replacement of the product. In case of damage and / or malfunction of the delivered goods, the Buyer can return the item to the above address, in order for the complaint to be accepted on the basis of physical evidence. If a careful examination determines that the product has been damaged by an intentional/accidental mechanical procedure, which occurred after the product was inspected and sent to the customer, the complaint will be rejected or contested. In such a case, the material liability of the buyer for the purchased product is determined.
It is also pointed out that according to Art. 43. If the material defect on the product occurs within six months from the date of transfer of risk to the Buyer (from the date of purchase of the product), and the trader considers that the defect did not exist at that time, the costs of the expert's report shall be borne by the trader. If the material defect on the product occurs after six months, but not later than 24 months from the date of the transfer of risk to the Buyer/Consumer, the costs of the expert's report shall be borne by the consumer or trader, depending on the result of the expert's report. The trader is not liable for material defects on the product that occur after two years from the purchase of the product. The product to be advertised must be purchased via www.opgnovosel.hr and preferably be presented with the original invoice.

In order to respond to a written complaint not sent by e-mail to the consumer OPG Novosel, consumers are asked to provide accurate information on their name and address and the address to which they will be provided with a reply. The response to the consumer's complaint must be provided by OPG Novosel in writing no later than 15 days from the date of receipt of the complaint.
In the event of a possible dispute, OPG Novosel and the consumer will settle the dispute peacefully, and if it is not possible, the Municipal Civil Court in Zagreb has jurisdiction under Croatian law. Dispute resolution is possible before the Court of Honour of the Croatian Chamber of Commerce or other mediation centres.
Consumer disputes can be resolved through the European Commission's ODR platform.
If the consumer accepts the General Terms and Conditions, he accepts all other terms and conditions listed on the website www.opgnovosel.hr and all other terms and conditions listed on that website. If the consumer does not agree with any part of the pre-contractual notice or the General Terms and Conditions, he/she is kindly requested not to use the website www.opgnovosel.hr and not to conclude a sales contract.
OPG Novosel reserves the right to change these General Terms and Conditions without prior notice. General terms and conditions are in accordance with the laws of the Republic of Croatia.
If the buyer is a legal person, it is not subject to the consumer protection rules laid down in the Consumer Protection Act. The rules on the written complaint of consumers do not apply to legal persons, to whom the Civil Obligations Act and the Electronic Commerce Act apply.
PRODUCT SUSTAINABLE INSTRUCTIONS
SUSTAINABILITY OF PRODUCTS FROM THE COURT OF AUTHORITY
Keep products made of dried flowers on dry place, protected from moisture and direct sun. Moisture can damage flowers, and sunlight can fade colors over time.
Do not water or put dry flowers in water. Keep the beetroots in an empty, dry vase.
Flowers are delicate, therefore with it handle gently and avoid frequent relocation. Carefully remove dust with a soft brush or a gentle jet of cold air from a distance.
With proper storage, Dry flowers can last for years.
SUHI ANRANGEMENTS ON OPEN
Set up dry outdoor arrangements on place protected from rain, moisture, strong wind and direct sun. Exposure to weather conditions can shorten their durability and cause colour fading.
For additional protection, you can choose wrapping with cellophane, which mitigates direct exposure, but does not make the arrangement waterproof. If condensation occurs inside the cellophane, allow ventilation and drying of the arrangement.
Avoid placing on a substrate where water is retained. Outdoor durability depends on location and weather conditions.
SUSTAINABILITY OF THE PRODUCTS OF FRESH TIME
Keep fresh flowers on cooler place, away from direct sun, heat source and fruit.
Bouquets and cut flowers: shorten the stems approximately before placing them in a clean vase 1-2 cm clean, sharp scissors. Remove the leaves that would be in the water. Change water daily, and periodically shorten the stems again.
Arrangements in a flower sponge: check the moisture of the sponge daily and if necessary slowly add a small amount of water directly to the sponge. Make sure that the water does not overflow the basket or container and does not wet the decorations.
Reduced flowers and leaves are regularly removed. The durability of fresh flowers depends on the type, temperature and method of maintenance.
These instructions apply to cut flowers. Arrangements with planted plants, such as custodians, require different care.
QUALITY OF PRODUCT AND RECLASSION
We make each product of OPG Novosel carefully, using natural materials. Due to handmade and seasonal availability of flowers are possible minor differences in shades, flower size and layout compared to photo, while preserving the style and overall appearance of the selected product.
If the product arrives damaged or has a defect, please contact us within 24 hours of downloading, to determine the condition of the product and resolve the complaint as soon as possible.

Natural aging, fading and veining of flowers do not constitute a disadvantage if they are in accordance with its nature, usual durability and description of the product. Damage caused by improper handling, inadequate storage or non-compliance with maintenance instructions is not a defect for which the seller is liable.
Application for registration within 48 hours does not limit the legal rights of the buyer due to material defects of the product.
